Factual Summary of Housing and Maintenance Concerns
Purpose of This Summary
This summary provides a chronological overview of maintenance, habitability, relocation, rent-calculation, and court-related concerns involving my residence at Montgomery Village Apartments.
It is intended to help legal counsel identify the principal issues without requiring sensitive supporting materials to be posted publicly. Photographs, medical records, court documents, correspondence, and detailed disputed allegations have been removed from this public-facing summary and preserved separately for confidential attorney review.
1. Maintenance and Habitability Concerns
Over an extended period, I reported recurring problems affecting the condition and use of my apartment. The reported concerns included:
- Moisture and condensation near the HVAC system.
- Suspected mold or fungal growth in areas affected by moisture.
- Bathroom water intrusion and recurring moisture around the commode and flooring.
- Damaged, softened, or potentially contaminated flooring.
- Pest activity in and around fixtures, utility areas, vents, and wall openings.
- Missing or inadequate weather stripping around exterior doors.
- Drafts, damaged door sills, and structural openings.
- Ventilation and temperature-control problems.
- Concerns involving electrical wiring, plumbing, and unfinished maintenance work.
Some repairs were performed, including work involving the commode seal and portions of the HVAC area. However, I remained concerned that the underlying moisture, flooring, ventilation, pest, and structural conditions had not been fully inspected or corrected.
2. Maintenance Scheduling and Access
I did not intend to prevent necessary maintenance from being completed. My requests concerned how maintenance access would be scheduled and conducted.
Because of mobility limitations, medical appointments, medication routines, personal-care needs, and the need for privacy during bathroom work, I requested:
- Reasonable advance notice.
- A defined morning or afternoon arrival period.
- Clear identification of the work to be performed.
- Sufficient time to prepare the apartment.
- Privacy and safe access during bathroom or bedroom-related repairs.
- Coordination with previously scheduled medical obligations.
Disagreements later arose concerning whether my scheduling requests amounted to a refusal of maintenance access. I dispute the characterization that I categorically refused necessary repairs.
3. Proposed Temporary Relocation
A temporary motel stay was proposed while repairs were to be completed.
Before relocating, I requested clarification and assistance regarding:
- Transportation.
- Moving luggage and necessary personal items.
- Safe use of my rollator.
- Accessibility of the room and motel premises.
- Food storage and dietary needs.
- Medication and medical-equipment arrangements.
- The reservation name and identification requirements.
- The proposed repair schedule and expected length of displacement.
I did not believe these practical and disability-related concerns had been adequately resolved before the scheduled relocation.
A charge of approximately $575 was later attributed to the unused motel reservation. I dispute responsibility for that charge and request review of the circumstances surrounding the reservation and requested accommodations.
4. Rent and Income-Calculation Concerns
I also raised questionsv regarding the calculation of my tenant rent, utility allowance, and Social Security income.
The principal issues include:
- Whether Social Security overpayment deductions were properly considered.
- Whether the amount actually received should have been used in determining annual income.
- Whether applicable medical or disability-related deductions were included.
- Whether utility-allowance changes were correctly applied.
- Whether rent adjustments and recertifications were accurately calculated.
- Whether payments already made were correctly credited.

5. Court Proceedings
Housing-court proceedings occurred after disputes arose concerning maintenance access, temporary relocation, rent, and related charges.
During those proceedings, statements were made regarding:
- My alleged refusal to permit maintenance.
- My alleged refusal to accept temporary relocation.
- The motel-reservation charge.
- The amount allegedly owed.
- My conduct during communications with housing personnel.
- My medical and mobility circumstances.
